Nissan LEAF Reservation Terms and Conditions
1. After submitting your Nissan LEAF Pre-Order Reservation (“Reservation”) online and making your reservation payment of €232 (“Reservation Payment”), you will be allocated a reserved place in the order waiting list for ordering a Nissan LEAF according to your chosen configurations.
2. After submitting your Reservation and making your Reservation Payment, you will be sent an official receipt by e-mail setting out:
- a unique Reservation Reference number;
- the specification details of the Nissan LEAF that you have configured; and
- the recommended retail price for your Nissan LEAF (net price plus taxes and “on the road charges”) n.b. Your Nissan LEAF Dealer will confirm the actual net price (plus taxes and “on the road” charges) of your Nissan LEAF at the time you place a firm order and enter into a contract to buy a Nissan LEAF.
3. When Nissan has selected the Nissan LEAF Dealer Network, a list of Nissan LEAF Dealers will be available on www.nissan.ie (the “Website”). Nissan will tell you when details of Nissan LEAF Dealers are available and will ask you to choose a Nissan LEAF Dealer. Only a Nissan LEAF Dealer can accept a firm order and enter a contract with you to purchase a Nissan LEAF. If you have not selected a Nissan LEAF Dealer within ten (10) days of being asked to do so, your nearest Nissan LEAF dealer will be assigned to contact you. Your Nissan LEAF Dealer will arrange a meeting with you to discuss your Reservation (including your chosen configurations) and invite you to place a firm order and enter into a contract with them to purchase a Nissan LEAF.
4. Your Reservation will be valid for thirty (30) days from the date your Nissan LEAF Dealer is appointed for you. If you do not enter into a contract with your Nissan LEAF Dealer to purchase a Nissan LEAF within this day period your Reservation will lapse and you will forfeit your place in the order waiting list.
5. Any references to Delivery Dates are estimates only and not a guaranteed date for delivery. Nissan undertakes to make best endeavours to ensure estimates are as accurate as possible. However, these estimated dates may change according to many factors and Nissan may not be able to respect such estimated dates nor to inform you should your estimated delivery date change. When you are contacted by your Nissan LEAF Dealer you will be informed of any change to the estimated delivery date and if you proceed to place a firm order and enter into a contract to purchase a Nissan LEAF any subsequent changes to this date will be governed by that contract which will supersede these Pre-Order Terms and Conditions.
6. The configurations selected at the time of submitting your Reservation may not be subsequently modified online. However, you will have the opportunity to confirm or modify your chosen configuration with your Nissan LEAF Dealer. Your Nissan LEAF Dealer will endeavour to accommodate your requirements and configuration but does not guarantee that any particular configuration, colour, variant, trim or other option will be available when you enter into a contract with your Nissan LEAF Dealer.
7. The price given at the time of placing your Reservation is the recommended retail price (net price plus taxes and “on the road” charges). Your Nissan LEAF Dealer will confirm the actual net price (plus taxes and “on the road” charges) of your Nissan LEAF at the time you place a firm order and enter into a contract to buy a Nissan LEAF. [Subject to certain conditions Irish government incentives might be available to you when purchasing a Nissan LEAF.
8. A Reservation does not constitute an order for a Nissan LEAF or a contract to purchase a Nissan LEAF. Either you or Nissan may cancel your Reservation and elect not to enter into a contract of sale in relation to a Nissan LEAF at any time prior to you entering into a contract to purchase a Nissan LEAF from your Nissan LEAF Dealer. If your Reservation is cancelled by you or Nissan your reserved place in the order waiting list is forfeited.
9. Your Reservation Payment will be fully refundable by Nissan if (a) you decide not to enter into a contract with your Nissan LEAF Dealer to purchase a Nissan LEAF; (b) before entering into a contract with your Nissan LEAF Dealer to purchase a Nissan LEAF your Nissan LEAF Dealer becomes unable to accept your order for a Nissan LEAF; (c) your Reservation lapses; or (d) your Reservation is otherwise cancelled. If you are entitled to a full refund of your Reservation Payment, Nissan will return your Reservation Payment to you in full as soon as reasonably practicable and in any event no later than thirty (30) days from the date on which your Reservation was cancelled. Neither Nissan nor your Nissan LEAF Dealer shall have any further liability to you whatsoever (including any liability to pay interest in respect of the Reservation Payment).
10. Should you decide to cancel your Reservation at any time before you enter a contract to purchase a Nissan LEAF you should log on to the member page of the Website to cancel your Reservation and receive a full refund, without interest, of your Reservation Payment.
11. Your Reservation Payment (and any additional pre-payment required by your Nissan LEAF Dealer at the time of placing the order) will be deducted from the purchase price, (before taxes and “on the road charges”) of your Nissan LEAF.
12. If you place an order and enter into a contract to purchase a Nissan LEAF, the contract will be subject to and governed by your Nissan LEAF Dealer’s standard terms and conditions of sale. Your Reservation Payment may become non-refundable at this point.
13. Your Reservation is personal to you and is non-transferable. If you attempt (without the express consent of Nissan) to assign or transfer your Reservation to a third party (i.e. sell or trade), or if you otherwise breach these Pre-Order Terms and Conditions in any way whatsoever, Nissan shall be entitled to cancel your Reservation and return your Reservation Payment, without interest.
14. Reservations are available for genuine retail end user customers only. Only one Reservation is available per person.
15. All correspondence will be sent using the details supplied by you via the online form when making your Reservation. If your contact details change you will need to log on to the member page of the Website and update them online. Neither Nissan (nor any of the Nissan LEAF Dealers) shall be liable for any consequences arising from your failure to update a change of your contact details.
16. Except as required by law, neither Nissan nor any Nissan LEAF Dealer shall have any liability whatsoever to you for any liability, claim, cost (including for example any legal costs), loss (including without limitation consequential loss, loss of profit or special loss), damage or expense which may be incurred by you arising from or in connection with any Reservation.
17. If any part(s) of these Pre-Order Terms and Conditions is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of these Pre-Order Terms and Conditions, and the validity and enforceability of the other provisions of these Pre-Order Terms and Conditions shall not be affected.
18. These Pre-Order Terms and Conditions govern the agreement between you and Nissan in relation to your Reservation.
19. Neither your Nissan LEAF Dealer nor Nissan shall be liable for any failure or delay in performance of these Pre-Order Terms and Conditions which is caused by circumstances beyond their reasonable control.
20. These Pre-Order Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland and the parties submit to the exclusive jurisdiction of the Irish Courts.
Definitions
“Nissan” means Nissan Ireland or any of its associated companies.
“Nissan LEAF Dealer” means a member of the Nissan LEAF Dealer Network.
“Nissan LEAF Dealer Network” means the persons appointed by Nissan as LEAF Dealers in Ireland.
